Maryland State Law Library Maintains Excellent Site for Research on Health Claims Malpractice Act

For those interested in getting started with research on Maryland's Health Claims Malpractice Act, which among other things, requires the filing of certificates of qualified experts as discussed in prior blog posts, the Maryland State Law Library maintains an excellent bibliography on the subject at http://www.courts.state.md.us/lawlib/researchtools/bibliographies/healthclaimarbitration.html Although not exhaustive in content, sources or citations, the link provides a excellent starting point for those seeking information on the operation and interpretation of the Act. Washington State Supreme Court Rules State's Certification Statute for Malpractice Claims Unconstitutional

In a prior blog on our list, we questioned the constitutionality of the Maryland law requiring medical malpractice plaintiffs to file certificates of meritorious claim, otherwise known as certificates of qualified expert, wherein an expert is required to attest that a breach of care occurred and caused the plaintiff injury. We questioned the statute due to its unfairness and the special burden it places upon malpractice plaintiffs to substantiate their claims at a very early stage in the litigation process.
