Maryland Surgical Error Lawyer

Surgery has risks, everybody knows that. But sheer carelessness by medical personnel is not a risk you should have to bear. Communication breakdown is a major cause of error. Just ask the patient who has a poorly placed jaw implant and consequent excruciating pain - better planning and understanding of the device and its correct placement could have prevented it.

2. Competency problems. Believe it or not, some surgeons are simply not trained well enought to do what they try to do. Some operating room personnel may be subpar as well. Young surgeons may be pushed further than is appropriate for their skill level trying to compete and advance as a doctor. When a mistake happens that would have been avoided in the hands of a more highly trained or differently trained professional, that is carelessness. For example, a patient had bariatric surgery performed by a physician who was only on his third such procedure; she died of complications due to the doctor's incompetency.

3. Personnel problems. Studies have shown that fatigue, inattention, inability to read handwriting, and similar problems can cause surgical error. Surgeons are sometimes awake for 24 to 36 hours and sometimes perform far too many procedures in a day. As a result, mistakes may more readily be made. One overly-tired surgeon removed a slab of fat and told the patient he had removed his appendix. A second operation had to be performed.
