Pain & Suffering - Personal Injury Damages
Pain and suffer can be a difficult loss to assign a dollar figure. Typicaly pain and suffering refers to any pain, embarassment or humiliation the victim has suffered from the accident. What if you are now unable to enjoy activites you were able to before? This unique type of loss is where pain and suffering comes into play.
How are pain and suffering values calculated?
Typically your personal injury lawyer will speak with you and learn about you and your unique case. Each person is different, likewise every injury case is different. What affects one person one way may not affect another in the same way. Your injury lawyer will speak with the insurance company to try and convince them you are in need of compensation for your pain and suffering damages. The insurance company may deny your pain and suffering damages. What happens then? Well when an insurance company denies or tries to lower your payout that simply means they will not pay volintarily. If this happens you case may be taken to trial. This is why its important to choose an experience personal injury lawyer, one that has experience winning cases in trial. Not many cases go to trial so some lawyers may have little trial experience. Make sure you speak to your lawyer to find out their prior courtroom experiences. Your lawyer will represent you in a court of law and ultimately it may be in the hands of the judge and jury.
Some common types of pain and suffering cases can include permanet disfigurement. If you were serious injured in an auto accident you may have been fully compensated for your medical bills, lost wages and property damages. However, what if you have a permanent scar on your face? This would fall under pain and suffering damages. Your personal injury lawyer may fight on your behalf to get you additonal compensation for the scar.
Factors that may influence pain and suffering damages
- Age of accident victim
- Severity of the injury
- How did the injury impact the daily life of the victim
- Life expectacy of the victim
