Engine trouble resulted in deadly motor vehicle accident

Breaking down on the side of the road can be a colossal inconvenience for Maryland residents. It can also be dangerous. There are too many media reports of a pedestrian on the side of the road because of engine trouble being killed in a motor vehicle accident.

The most recent of these stories involves a man whose vehicle broke down on Maryland Route 5. As he was at the front of his vehicle surveying the problem, another vehicle swerved off the road onto the shoulder and struck the back of his vehicle. It then struck him. The impact threw him into the grass of the shoulder of the roadway.

A trooper with the Commercial Vehicle Enforcement Division happened upon the scene. The trooper and an off-duty registered nurse who happened by provided emergency medical care to the victim until troopers with the Maryland State Police and emergency medical personnel arrived. Sadly, their efforts were in vain because the man succumbed to his injuries at an area hospital.

The driver of the second vehicle reportedly suffered only minor injuries. The Maryland State Police Crash Team is handling the investigation. It is not yet known whether the woman driving the second vehicle will face criminal charges in connection with the crash and the man’s death.

Regardless, his surviving family members may exercise their right to file a wrongful death claim against the woman. If the evidence establishes that negligence led to the death of their loved one, a civil court may award damages. Any restitution received from such a monetary judgment could help defray the costs and other damages associated with a fatal motor vehicle accident.
